Acceptance of Terms

By accessing or using LitFantasy (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Service. These Terms are a binding legal agreement between you and LITFANTASY LLC.

Description of Service

LitFantasy is a fantasy football research and draft assistant. We provide player data, rankings, projections, and tools designed to help you prepare for and manage fantasy football drafts and teams. We provide this information for informational purposes only. We are not a fantasy sports operator, gambling service, or paid contest platform. We do not offer picks-for-money, wagers, or betting of any kind.

For Entertainment Use Only

The information provided on LitFantasy is for entertainment and informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any data, projections, rankings, or other content. Nothing on this site constitutes financial, wagering, or investment advice. You are solely responsible for your own decisions and activities.

User Accounts

To use certain features, you must create an account with a valid email address through Amazon Cognito. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

Free and Paid Tiers

LitFantasy currently offers a free tier. We may in the future offer paid tiers with additional features. Terms specific to paid tiers, including pricing, refunds, and cancellation, will be presented to you at the time of purchase.

User Data

You own your draft data. LitFantasy stores your draft state to provide the Service. Your user data is private to your individual account and is not shared publicly or sold to third parties. We handle your data in accordance with our Privacy Policy.

Acceptable Use

You agree not to:

• Scrape, crawl, or systematically collect data from the Service without permission;
• Reverse engineer, decompile, or attempt to derive the source code of the Service;
• Resell, redistribute, or commercially exploit Service data without authorization;
• Use automated tools, bots, or scripts to access the Service without our prior written consent;
• Abuse, harass, interfere with, or disrupt the Service or other users; or
• Infringe the rights of others or violate applicable laws.

Intellectual Property

The LitFantasy name, logo, branding, code, designs, and original content are the property of LITFANTASY LLC. Player statistics, team names, and other sports data are sourced from public APIs and third-party data providers. LITFANTASY™ is a trademark of LITFANTASY LLC. You may not use our trademarks or materials without our prior written permission, except as expressly permitted by these Terms.

Third-Party Content

We reference NFL players, teams, and statistics for informational purposes. We are not affiliated with the NFL, NFLPA, or any individual team or player. All trademarks, logos, and other intellectual property belonging to third parties are the property of their respective owners.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITFANTASY LLC’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO LITFANTASY LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (US $100), WHICHEVER IS GREATER. THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

Indemnification

You agree to indemnify, defend, and hold harmless LITFANTASY LLC and its members, managers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the Service, your content, or your violation of these Terms.

Governing Law

These Terms and any dispute arising out of or relating to them will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of laws principles.

Dispute Resolution / Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Massachusetts. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Small-claims court carve-out: Either party may bring an action in small-claims court for claims within that court’s jurisdiction instead of arbitration.

Class action waiver: To the fullest extent permitted by law, you agree that any proceedings to resolve disputes shall be conducted only on an individual basis and not as a class action, collective action, or representative action.

Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated by email to registered users and through an in-app banner for at least 30 days before taking effect. Continued use of the Service after the effective date of a change constitutes your acceptance of the revised Terms. Non-material changes may be posted with an updated “Last Updated” date.

Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to us, other users, or third parties. You may delete your account at any time by contacting us or using any account-deletion feature we make available.

Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and LITFANTASY LLC regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. We may assign our rights under these Terms without restriction; you may not assign your rights without our prior written consent.
